Not surprising, another obituary’s headline read, “Kit Carson’s Cousin Dies in Ogden.” And still another obituary stated that he was intimately acquainted with such immortal characters as California Joe, Buffalo Bill Cody, Wild Bill Hickok and Major Inman.192

Frank’s wife, Irene Carson, also possessed a list of credentials. She bore and raised nine children, including two sets of twins, and she was actively involved in the Ladies of the Maccabees, the Silver Hive, No. 1, where she served in several offices, one of which was lady commander.193 When Irene died on June 16, 1923, the Ladies of the Maccabees demonstrated their regard by making plans to drape the charter in memory of her during a memorial service in July.194

In light of the family being dedicated to community and civic affairs, the presence of an outlaw in their midst would seem unlikely. However, considering the number of outlaws operating in the West, perhaps this wasn’t so unusual. The details of when and where Elijah Canary met and charmed this law-abiding family is, unfortunately, a mystery.

It was not a happy first Christmas for the young couple. On December 3, 1895, less than one month after Elijah and Kate’s marriage, a criminal warrant from the Uinta County was issued for his arrest. The newspapers were ecstatic about nailing the outlaws, but Kate would have been horrified. Elijah Canary was charged with the crime of placing obstructions on a railroad, namely horses. This rather brutal crime brought about the order for his arrest. A warrant was also issued for Oliff Helquist (also spelled Hilquist), alias J.B. Johnson, and William Dawling, alias William Kunz, the same day.195

Confusion exists as to exactly where Elijah was arrested. The Ogden Standard headlined a news flash, “An Important Arrest, Elijah Cannary an Alleged Wyoming Criminal Jailed Here Saturday.” The newspaper reported that Sheriff Wright arrested Elijah Canary in Ogden at Landsberg’s saloon. Canary was wanted in Idaho and Wyoming to answer to several charges against him. Sheriff Ward of Evanston, Wyoming, telegraphed Sheriff Wright that he would be there the same day with requisition papers for Canary. Elijah was said to be one of the ring leaders of an organized gang of outlaws that, for several years, had been operating in Wyoming and Idaho. It can be concluded from the article that Elijah had been stealing horses for a number of years:

It is said that their method has been to steal horses…This nefarious scheme is said to have been worked very successfully and the gang has obtained several hundred dollars through the courts in this way. It is said that another of the ring leaders of the gang is now in jail in Evanston and others are being arrested on suspicion of being implicated in the work of the criminals.196
